On April 21, Partner Susan Kohlmann was recognized by the National Council of Jewish Women New York (NCJWNY) with its Woman Who Dares Award. Two years after the US Supreme Court’s decision in Abitron Austria GmbH v. Hetronic International, Inc., US trademark owners and global businesses continue to grapple with its implications for cross-border enforcement. The ruling marked a significant shift in how—and where—trademark rights can be asserted under the Lanham Act, prompting many companies to reassess their international intellectual property strategies.

On February 26, 2025, in a unanimous opinion, the US Supreme Court vacated a $43 million trademark infringement award and ruled that trademark plaintiffs cannot recover profits from defendants’ affiliates when those affiliates are not themselves named as defendants in the lawsuit.[1]The Supreme Court’s decision vacated plaintiff Dewberry Engineers’ award because it disgorged profits from defendant Dewberry Group’s affiliates without those affiliates being parties to the suit.

The US Air Force agreed today to re-review the less-than-honorable discharges received by thousands of veterans because of mental health issues or sexual trauma experienced during their service.   

On September 25, US District Judge Paul Gardephe issued an order granting a Jenner & Block team’s motion to dismiss the federal trademark claims brought by Liberty Tax Service. The plaintiff alleged that clients AMC Networks Inc. and Sony Pictures Television Inc. had infringed on their trademark and trade dress with the depiction of a fictional business in the show “Better Call Saul.”
