In her editorial, Partner Susan Kohlmann, President of the New York City Bar Association, responds to recent debate about the Commission on Judicial Nomination. The 12-member panel is constitutionally mandated to screen candidates to serve on the New York Court of Appeals, but some in New York’s political community have opined that the commission should be cast aside as it wrestles with filling commission vacancies that could hamper its ability to put forward candidates on the court.

On February 26, 2025, in a unanimous opinion, the US Supreme Court vacated a $43 million trademark infringement award and ruled that trademark plaintiffs cannot recover profits from defendants’ affiliates when those affiliates are not themselves named as defendants in the lawsuit.[1]The Supreme Court’s decision vacated plaintiff Dewberry Engineers’ award because it disgorged profits from defendant Dewberry Group’s affiliates without those affiliates being parties to the suit.
