Partner Todd Toral is a co-author of "A Report on Corporate Counsel Arbitration Preferences," published in the May 2026 issue of Alternatives. The report summarizes findings from a survey of corporate counsel attending the 2026 CPR Annual Meeting, conducted in collaboration with the College of Commercial Arbitrators (CCA).
The survey captured preferences of experienced in-house lawyers actively managing arbitration portfolios across a range of industries. Respondents expressed strong support for party appointments of arbitrators, three-member tribunals in larger disputes, proportional discovery driven by party agreement, and in-person evidentiary hearings. These responses reflect a consistent preference for party autonomy and deliberative quality over measures designed to achieve structural efficiency.
