In a Law Society Gazette article, Special Counsel Lucy Blake discusses the UK government’s decision to deny a senior female judge, whose background in imprisoning members of the Taliban made her a target, permission to enter the country. Lucy describes the decision as “impossible to comprehend” and “deeply disappointing.”
“Y and her son are in acute danger from the Taliban as a direct result of Y having fought for and defended democracy, women’s rights, and the rule of law - the very values and freedoms upheld by the UK in Afghanistan. They have close family members who want – and have the means – to house and support them in the UK, meaning their relocation wouldn’t even incur a cost for the taxpayer,” she said.
Jenner & Block alongside Kingsley Napley and counsel Helen Foot of Garden Court Chambers lodged an appeal on behalf of their client and her son. After receiving the appeal, the Immigration Tribunal directed the Home Office to conduct a review of its decision. On January 6, 2023, the Home Office Pre-Appeals Review Unit denied the client’s case once again, citing a lack of “sufficient compelling and compassionate circumstances.”
The client’s case will now proceed to an oral hearing at the Immigration Tribunal in March 2023.
