What the Death of Chevron Means for Real Estate & Hospitality

The Supreme Court’s 2023-2024 Term upended the administrative state as we knew it when the Court overturned a 40-year precedent that established that courts should defer to federal agencies’ interpretations of ambiguous statutes, known as Chevron deference. Our panel will examine the reversal of Chevron, and the significant uncertainty this decision injected into the regulatory landscape. They will discuss how Real Estate and Hospitality businesses facing any form of regulatory scrutiny may experience—and may capitalize on—these developments. They will also preview what big cases are anticipated in the Supreme Court’s 2024-2025 Term.
