On 27 June 2024, the UK Court of Appeal upheld an action by international NGO, World Uyghur Congress, and found that the National Crime Agency had acted unlawfully in deciding not to open a money laundering investigation into the importation of cotton allegedly produced using forced labour in China’s Xinjiang Uyghur Autonomous Region.

On 23 April 2024, the European Parliament approved the much-anticipated regulation banning products made with forced labour from entering the EU market (the ‘Forced Labour Ban’). The approved text builds on the provisions of the European Commission’s proposal of 14 September 2022 (the ‘Proposal’), which we addressed in our client alert: The EU Proposed Ban on Products Made with Forced Labour: Four Things You Need to Know. 

On April 24, 2024, the European Parliament approved the Corporate Sustainability Due Diligence Directive (CS3D). The directive, which must be formally endorsed by the Council of the European Union (EU) before officially becoming law, imposes a corporate due diligence standard for human rights and the environment. Companies found to violate the CS3D may be fined up to 5% of the company’s global net turnover.
