Jenner & Block Team Secures $17.7 Million in Damages for Clients Kraft, Kellogg, General Mills, and Nestle

An Illinois federal jury awarded clients Kraft Heinz Co., Kellogg Co., General Mills Inc., and Nestle USA Inc. $17.7 million for the damages they suffered from the overcharges they paid due to a conspiracy to inflate the prices of eggs by the nation’s largest egg producers and two industry groups. The plaintiffs are entitled to have the $17.7 million trebled. 

Last week, during the liability phase of the trial, a jury found that the conspiracy Cal-Maine Food, Rose Acre Farms, United Egg Producers, and United States Egg Marketers participated in included four components: the short-term measures such as early slaughter, early molting, and flock reduction; exports as part of the USEM export program, which were intended to increase domestic egg prices; cage space or henhouse density restrictions as part of the UEP Certified Program; and restricting backfilling of egg-producing hens as part of the UEP Certified Program.
