Court Grants Unilateral Motion to Terminate Removal Proceedings for Guatemalan Client

Client Contracts Counsel Michael DeMar secured the termination of removal proceedings against a 15-year-old client from Guatemala in the New York Immigration Court, a pro bono matter that the firm is handling for Safe Passage Project.
Michael drafted and filed the motion just days after the Executive Office of Immigration Review’s recently enacted rule which codifies the power of immigration judges to terminate removal proceedings where, as in the instant case, the government’s attorney refuses to exercise prosecutorial discretion to dismiss the proceedings despite good cause being shown.
Thanks to this win, the client will no longer have to appear in immigration court and with no removal proceedings actively pending against him, the client will not have to worry about being deported based on the charges that the government had previously brought against him.
Partner Brian Fischer is the supervising partner on the case. Michael and Brian previously obtained employment authorization for the client and have secured the client’s adjustment of status to Lawful Permanent Resident (Green Card holder) as soon as a visa becomes available, putting the client on the path to American citizenship.
