Client Roku Prevails Against $41 million Infringement Claim at Federal Circuit

On November 5, the Federal Circuit unanimously affirmed a jury verdict that cleared firm client Roku of claims it infringed a streaming media technology patent, marking the end of multiyear litigation in which MV3 had claimed $41 million in damages. The three-judge panel issued the ruling just two days after holding a hearing on MV3’s motion for a new trial.

“This was a hard-fought case from the very beginning,” said Partner Alexander Hadjis, who led the Jenner & Block team.  “This Federal Circuit decision affirms the strength of the jury’s verdict and we are pleased to have finally put it all to bed for Roku.” Mr. Hadjis also led the defense win for Roku at a trial in October 2020 at the first patent trial before US District Judge Alan Albright in the Western District of Texas. The Federal Circuit decision marks the first review of a trail outcome from Judge Albright on merits.

Partner Adam G. Unikowsky argued for Roku before the Federal Circuit, and the appellate team also included Department Counsel Yusuf Esat and Associate Krystalyn Kinsel.
