Today, Jenner & Block, on behalf of St. Luke’s Health System and in collaboration with Stoel Rives, filed a lawsuit with the US District Court for the District of Idaho to resolve the conflict between Idaho’s state abortion law and the federal Emergency Medical Treatment and Labor Act (EMTALA).

The US Supreme Court heard oral arguments on Wednesday in the consolidated cases of Moyle v. United States, Case No. 23-726 and Idaho v. United States, Case No. 23-727. These cases asked the justices to consider whether the federal Emergency Medical Treatment and Labor Act (EMTALA) conflicts with Idaho’s criminal abortion ban, which applies to all abortions except those “necessary to prevent the death of the pregnant woman” or that follow reported rape or incest. Idaho Code § 18-622.

In a unanimous decision, the US Supreme Court today ruled in favor of our client, Yonas Fikre.

Mr. Fikre is a law-abiding US citizen who was stranded overseas for four years after the FBI placed him on the No Fly List. Mr. Fikre sued, alleging that his placement on the No Fly List violated his constitutional rights to due process.
