Overview

Gabriel “Gabi” Gillett advises companies and individuals on important legal issues they are facing on appeal, in trial court and before litigation ensues. Gabi’s practice is diverse. From class actions to antitrust to securities disputes, and contract battles to regulatory and statutory challenges, he routinely wins his clients most complex cases by delving deeply into the subject matter and working tirelessly to achieve their goals. These clients are as diverse as the subject matters Gabi litigates―he has secured successful outcomes for clients in the restaurant, finance, energy, distribution, food manufacturing, commodities, technology, telecommunications, and healthcare industries.

The common thread among Gabi’s cases is that they require understanding the big picture concerns, mastering the details, and then developing and executing thoughtful strategies to maximize success. That means thinking about not just the narrow or short-term legal issue, but also about the business implications, optics, and other forces at play—including current trends and potential issues on the horizon.

After law school, Gabi served as a law clerk for judges on the US Court of Appeals for the Third Circuit and the US District Court for the Southern District of New York. Gabi also previously served as Deputy Director of Rapid Response on John McCain’s 2008 presidential campaign. He is now a leader in the Chicago Bar Association, having chaired or vice-chaired the Civil Practice and Class Action committees. He is also a leader in the community, serving on the board of the Wrightwood Neighbors Association, the Jonquil Park Advisory Council, and the Local School Council of Oscar Mayer Magnet School.

Representative Matters

Securities

  • Secured dismissal of numerous Section 14A lawsuits brought across the country challenging a merger with a public company, dismissal of securities fraud claims under 10b-5, and dismissal of related derivative and ERISA claims.

Class Action

  • Won reversal of a jury verdict in favor of a class asserting claims under the FDCPA, by persuading the Seventh Circuit that the class representative lacked standing to sue because she had not been injured.

Antitrust

  • Secured dismissal of a putative class action alleging a conspiracy to restrain trade through a hub-and-spoke conspiracy theory, which the Seventh Circuit rejected on appeal, and a separate independent vertical conspiracy theory, which the district court rejected on remand and the Seventh Circuit affirmed.

Insurance

  • Persuaded a New York federal court to grant summary judgment that a settled insurer was immune from contribution claims from a non-settled insurer and to reverse an earlier ruling to the contrary. The decision led to a favorable nine-figure settlement amid trial.

Regulatory

  • Represented the 11 museums that currently operate on parkland in Chicago as amicus curiae supporting dismissal of a lawsuit claiming that the plan to build the Obama Presidential Center in Jackson Park violated the Public Trust Doctrine and First Amendment, among other laws. The District Court agreed and dismissed the suit; the Seventh Circuit affirmed.

Bankruptcy

  • Convinced the Second Circuit to affirm the dismissal of a bankruptcy claimant’s attempt to use Federal Rule of Civil Procedure 60(b) to undo a settlement with the estate of a bankrupt corporation years after the fact, in In re Motors Liquidation Co. (Handled prior to joining Jenner & Block).

Prisoner and Civil Rights

  • Advocated on behalf of non-profit organizations for the US Supreme Court to grant petitions for certiorari in cases relating to due process rights in civil commitment proceedings involving deaf persons and challenging an inhumane method of lethal-injection execution.
