In Chapter 13 in the American Bar Association’s annual publication, The State of Criminal Justice 2024, Partners Anne Cortina Perry, Shoba Pillay, and Joanna Wright, and Associates Emily Mannheimer, Isabel Farhi, and Illyana Green discuss the legal landscape for abortion care following the US Supreme Court’s decision in Dobbs v. Jackson Women’s Health Org. in 2022, which reversed Roe v. Wade.
In this essay, Partner Joanna Wright explores the expansion of judicially created exceptions to criminal procedure rights and legislation eliminating criminal procedure rights for certain groups of people or for all people in certain situations. As a backdrop of her examination, she harkens to the arrest of the surviving suspect in the 2013 Boston Marathon Bombing, a case that spurred a vigorous debate over his constitutional rights.
In this Note, Partner Joanna Wright systematically analyzes every state and federal court opinion that asserts the appropriate application of the Public Safety Exception (PSE), which admits un-Mirandized statements made in response to questions intended to secure public safety. Ultimately, she concludes that the PSE is a fact-sensitive, capacious device equipped to properly handle the unique nature of terrorist interrogations, due largely to its malleability in the hands of the courts.

The panel, titled “When to Settle vs. Litigate: Corporate Strategy” discussed key factors that should drive settlement versus litigation strategies, including risk assessment, cost-benefit analysis, precedent considerations, and stakeholder impact.
