Jenner & Block successfully defended its client Jet Logistics Inc. against a termination for default issued by the United States Transportation Command (USTRANSCOM), preserving the company's Air Ambulance Blanket Purchase Agreement and its ability to continue providing critical transportation services to severely ill and injured servicemembers.

Department of War Suspends CMMC Phase II—But Compliance Obligations Remain, As Does Enforcement Risk
On July 13, 2026, the Department of War (DoW) announced the immediate suspension of the Phase II requirements of the Cybersecurity Maturity Model Certification (CMMC) program, which had been scheduled to take effect on November 10, 2026. The suspension, memorialized in a memorandum dated July 10, 2026, and signed by DoW Chief Information Officer Kirsten Davies, also halts the pending Phase III and Phase IV implementation milestones and directs a comprehensive, 60-day review of the program.
The Fix Is In: Cost-Reimbursable Contracts Are Out
On April 30, 2026, President Trump issued an Executive Order that fundamentally shifts the “default” posture of federal acquisitions. Under the EO, fixed-price contracts and performance-based contracts become the “default and preferred method” of federal procurement. All non-fixed-price contracts—including cost-reimbursement, time-and-materials, and labor-hour—now require written justification, and those exceeding specified dollar thresholds require formal approval (with narrow exceptions).
