Jenner & Block Secures Appellate Victory for US Tsubaki Holdings
Jenner & Block obtained a resounding victory when the New York State Supreme Court Appellate Division, First Department ruled on a critical appeal. The court unanimously reversed a trial court decision, reinstating all four fraud causes of action (for fraudulent inducement, fraudulent concealment, fraudulent misrepresentation, and aiding and abetting fraud) that the trial court had dismissed.
Team Represents New York Man Arrested Four Times on Erroneous Warrant
Jenner & Block Partners Elizabeth A. Edmondson and Michael W. Ross are representing a New York man who has been arrested four times, since 2009, on an erroneous warrant. SEC Reverses Position on Mandatory Arbitration Clauses in IPOs
On September 17, 2025, the US Securities and Exchange Commission (SEC) approved a policy statement (the Statement) that allows companies to include mandatory arbitration clauses in their governing documents for investor claims, reversing its longstanding practice of prohibiting companies intending to go public from doing so.
European Commission Decision at Odds with International Arbitration Practice
Many readers will be familiar with the Spanish renewables saga which centers on changes made by Spain to a renewable energy support scheme in 2007, which led to over 50 investment treaty arbitrations, including a number brought by Japanese investors. The European Commission has now invoked state aid to justify the non-payment of the resulting awards against Spain.
The Unintended Consequence of Russian Sanctions
The wave of Russian sanctions imposed since the invasion of Ukraine has led to counter measures by the Russian state which are now having significant practical consequences for parties caught up in disputes with Russian entities. The English High Court decision in Google LLC and others v. Nao Tsargrad Media and others1 provides a particularly noteworthy example.

The Yukos Saga Continues: English Court of Appeal Rejects Russian Plea of Sovereign Immunity
As all eyes focus on peace talks and the future of the Russia/Ukraine conflict, Russia recently suffered another defeat in the long running Yukos saga, with the English Court of Appeal confirming that Russia could not invoke immunity against enforcement of the infamous Yukos award.
In a decision of potential importance to arbitral award creditors and debtors, the US Court of Appeals for the Fifth Circuit recently reversed a federal district court decision confirming an English arbitral award on the basis that the district court lacked personal jurisdiction over the award debtor.[1]The award debtor had sought to enforce its foreign award in federal court in Louisiana under the Convention on the Recognition and Enforcement of Foreign Arbitral Awards (the New York Convention)
