The Ethics of Cybersecurity Before, During, and After an Incident

This program will explore an often overlooked aspect of cybersecurity incidents—what are lawyers’ ethical obligations with respect to their entities’ cybersecurity protocols? Lawyers have an ethical obligation to ensure their employers’ security adheres to the Rules of Professional Conduct and any applicable standard of care. We will outline those pre-incident obligations and discuss the obligations once an incident occurs, including the best practices for running a forensic investigation and trying to maintain privilege over the resulting forensic report.

Restrictive Covenants: Enforceability Challenges and Other Options to Protect Business Interests

This program will discuss the changing legal landscape, including increasing challenges to certain restrictive covenants at the state and federal level, so that employers can assess the risks and rewards of restrictive covenants and if a current covenant may need to be reviewed and modified based on change in the law. The program will also discuss thoughtful and creative solutions beyond restrictive covenants that employers may implement to protect their business interests where restrictive covenants may not apply or be enforceable.

US Supreme Court Term in Review

Panelists will engage in a lively and informative discussion on the recent past, current, and future US Supreme Court terms. They will focus on the impact of recent changes in the composition of the Court and the effect of those changes. They will also discuss Justice Breyer’s retirement and the confirmation hearings of Justice Ketanji Brown Jackson. The panel will discuss high-profile cases from the Term, including decisions on vaccine mandates, abortion, and the Second Amendment. And the panel will preview next Term, including a look at the affirmative action cases from Harvard and the University of North Carolina.
