エネルギー憲章条約（ECT）は、エネルギー分野への投資を疎かにして行われる資産の国有化その他の国家による恣意的で差別的な行為から投資家を保護するための多国間投資条約である。最も重要なのは、この条約によって、投資家は、国際仲裁を通じて加盟国に対し義務違反を主張することができる、という点である。最近まで、加盟国には、日本、EUと欧州諸国、英国、旧ソビエト諸国が含まれていた。
ECTは、日本の投資家によって請求されたものも含めて、近年スペインに対して多くの（50件以上の）仲裁請求がなされたことで最もよく知られていると思われる。これらの請求は、スペインの法律が再生可能インフラ投資に不利であることを理由として提起された。実質的に、スペイン政府は、再生可能エネルギープロジェクトで発電した電力に対して支払う関税を引き下げ、多くのプロジェクトを立ち行かない状態にした。この事例は、エネルギーや再生可能分野に巨額の投資が行われる将来、ECTが重要な投資家の保護手段となりうることを示唆している。ECTが機能すれば、投資家は、政府が恣意的に土俵を変えることはできないという安心感を得ることができる。
しかし、投資の支援、促進という明らかな利点があるにもかかわらず、多くの評論家は、この条約は、規制を抑制し、気候変動に配慮した政策立案の障害になると考えており、ECTによって、立法府が気候変動問題に取り組むことが制約されている、と主張している。その結果、多くの欧州諸国は、条約交渉やアップデートに向けた動きに不満を抱き、最近になって脱退したり、あるいは、脱退の意向を示したりしている。直近では、その中に英国も含まれている。
条約のサンセット条項により、これらの脱退は、その後20年間効力を有しない。しかし、この条約の将来は以前不透明であり、適用の可能性も小さくなっている。20年後にはECTが存在しない可能性も十分にある。
