On April 27, Partner Adam Unikowsky will argue before the Supreme Court of the United States in Chatrie v. United States. The matter centers on how the Fourth Amendment applies to geofence warrants—law enforcement tools that compel technology companies to produce location data for all users within a defined geographic area during a specified time period.
The case stems from a 2019 robbery of a federal credit union in Midlothian, Virginia, in which law enforcement served a geofence warrant on Google to identify devices near the bank at the time of the robbery. Although the district court found the warrant was not supported by probable cause, it allowed the evidence under the good-faith exception. The US Court of Appeals for the Fourth Circuit affirmed.
The Court's decision is expected to clarify whether Americans retain property or privacy interests in data held by third-party technology companies and under what circumstances the government may obtain a warrant to access digital records.
The Jenner team representing Mr. Chatrie is led by Adam with support from Associates Laurel Raymond and Annie Warnke.
