Oklahoma’s Ban on Gender-Affirming Care for Trans Adolescents Challenged in Lawsuit

Jenner & Block, in partnership with the American Civil Liberties Union, the ACLU of Oklahoma, and Lambda Legal, filed a lawsuit in Oklahoma challenging SB 613, a new law that bans necessary and often lifesaving gender-affirming medical care to transgender adolescents and threatens providers who violate the law with a felony conviction and discipline from their licensing boards.
The lawsuit was filed on behalf of transgender adolescents in Oklahoma and a medical provider specializing in adolescent medicine who is advocating on behalf of her patients. The group also filed a motion for preliminary injunction and brief in support.
“The law passed despite the sustained and robust opposition of medical experts in Oklahoma and across the country, and the myriad of Sooner families that stand to be negatively impacted. The Health Care Ban violates the constitutional rights of Oklahoma adolescents and their parents and will cause severe and irreparable harm.” the complaint says.
“SB 613 is an unconstitutional law that singles out transgender adolescents and discriminates against them and their families by banning necessary medical care and treatment,” said Partner Laurie Edelstein in a press release. “We are asking the court to block enforcement of SB 613 and protect the fundamental rights of transgender adolescents and their families to access appropriate medical treatment so that transgender adolescents have the same opportunity as their peers to thrive in their families, with their friends, in school, and in their communities.”
