Business Insurance sought insight from Jenner & Block Partner Brian S. Scarbrough on greenwashing, which is when an organization markets its operations, products, or initiatives as more environmentally friendly than they actually are. Companies should check to see if their insurance policies address ESG and greenwashing directly and whether “insurers are trying to reduce their liability for these types of claims and, conversely, if insurers are putting in affirmative coverage grants for these types of claims,” Mr. Scarbrough told the publication.
Mr. Scarbrough is a co-chair of the firm's Insurance Recovery and Counseling Practice. He represents corporate policyholders in disputes with insurers and has significant experience both in counseling regarding insurance coverage and in litigating insurance coverage disputes.
