Client Alert: Group Health Plan “Gag Clause” Compliance Attestation Due by the End of 2023
This is a reminder that a new compliance deadline is on the horizon for group health plans. The Consolidated Appropriations Act (CAA) of 2021 generally prohibits group health plans and health insurance issuers from entering into agreements containing gag clauses. An annual attestation of compliance with the gag clause prohibition is required, with the first due by December 31, 2023. On January 30, 2023, the Biden administration[1] announced that on May 11, 2023 it plans to end the COVID-19 national emergency (Outbreak Period) and public health emergency (Public Health Emergency), which were declared by the Trump administration in 2020. Since their institution, the emergency declarations have been extended many times without indication of a true sunset. Currently, the Outbreak Period will expire on March 1, 2023, and the Public Health Emergency will expire on April 11, 2023

2026 Retirement Plan Amendment Deadline: What Plan Sponsors Need to Know
By December 31, 2026, plan sponsors of certain qualified retirement plans, including 401(k) and defined benefit plans, must amend the plans to incorporate required and discretionary changes under the Coronavirus Aid, Relief, and Economic Security (CARES) Act, the Setting Every Community Up for Retirement Enhancement (SECURE) Act, and the SECURE 2.0 Act of 2022 (SECURE 2.0).[1]
