In Law360, Partner David Kroeger Examines Emerging AI Insurance Exclusions
Partner David Kroeger authored an article for Law360 analyzing how insurers are introducing generative AI exclusions across commercial general liability, directors and officers, and professional liability policies in response to increasing AI-related losses. David recommends that risk managers stay vigilant for these exclusions in new or renewal policies, recognizing how their businesses use generative AI, and how to be prepared to push back on proposed exclusions.

In their chapter, “Common Exclusions and Defenses to Coverage,” for the Illinois Institute for Continuing Legal Education’s (IICLE) Insurance Law – 2023 Edition, Partner David Kroeger and former department counsel Catherine Doyle discuss the role of exclusions found in some insurance policies. The chapter explores different types of exclusions, how they are interpreted, and the factors that are considered by the court when determining whether the exclusions will defeat coverage.

Jenner & Block Partner David M. Kroeger presented at the 2021 Virtual IBA Insurance Conference.
