In the profile, David said the case presents the questions of whether print newspapers are a separate antitrust market, which is the Las Vegas Sun’s position, or whether print newspapers face competition from online news, social media, and other digital sources, which is the Review-Journal’s position, the profile says.

“I believe that common sense and everyday experiences tell us that consumers are replacing their print newspapers with online and mobile news,” he said. “The shift from print to digital readership is something many of us have experienced for ourselves. Remarkably, this particular question has not been addressed by the courts since the explosion of smartphones and mobile news.”

He concluded: “One obstacle has been contending with an outdated 1970s ruling by an appellate court in a different circuit involving the Newspaper Preservation Act. That court relied on legislative history to interpret an otherwise unambiguous statutory provision — a practice that the Supreme Court now rejects.”
