Jenner & Block Wins Motion to Dismiss, Securing a Venue Change on Behalf of Volvo Cars in Patent Infringement Case

A Jenner & Block team, representing Volvo Cars, won a motion to dismiss for improper venue leading to a change of venue order in a patent infringement suit brought by Intellectual Ventures, moving the case from the Western District of Texas to the District of New Jersey.

Jenner argued that venue was not proper over certain Volvo Cars entities for a patent infringement claim in the Western District of Texas because the companies lack operations there.

US District Judge Alan Albright agreed with Jenner lawyers that Plaintiffs failed to establish an agency relationship between the named Volvo Cars entities and the independent Volvo dealerships in the district and for these reasons, the Court found venue over Defendants in this suit improper.

The Court concluded that because the Defendants have their principal place of business in New Jersey, the action could have been brought in the District of New Jersey and transferred the case there.  

The team was led by Partner Ben Bradford and also included Partner Reggie Hill and Associates Haley Tuchman and Mitch Denti.
