Jenner & Block Succeeds in Jurisdictional Appeal for Clearview AI

In May 2022, the United Kingdom’s Information Commissioner issued client Clearview AI with an enforcement notice and a £7.5 million penalty notice. Clearview appealed the notices substantively and on jurisdictional grounds, the latter of which was subject to a preliminary issue hearing before the First-tier Tribunal in November 2022.

On 17 October 2023, the Tribunal handed down judgment in Clearview’s favour, determining that the Commissioner had no jurisdiction to issue the notices as the General Data Protection Regulation (GDPR) and UK GDPR did not apply to the processing at issue, which concerned Clearview’s service to foreign governments and government agencies in their criminal law enforcement and national security activities.
