Jenner & Block Files Amicus Brief Opposing Texas’ Judge Shopping in Challenges to Biden Administration Policies

On September 19, Jenner & Block filed an amicus brief before the Supreme Court of the United States in United States v. Texas on behalf of Professor Steven Vladeck of the University of Texas at Austin School of Law. The brief highlights Texas’ deliberate and unprecedented strategy of judge shopping in cases challenging the Biden Administration’s policies. It uses empirical methods to demonstrate that Texas is repeatedly filing lawsuits in judicial fora where they have a high likelihood of assignment to a judge appointed by a Republican president, despite the fact that those venues often have little or no relationship to the underlying disputes.
The Jenner & Block team on the matter includes Partner Lindsay Harrison, Associate Samuel Ungar, and Senior Paralegal Cheryl L. Olson. The team is working in collaboration with the National Immigration Law Center.
