In their chapter, “Common Exclusions and Defenses to Coverage,” for the Illinois Institute for Continuing Legal Education’s (IICLE) Insurance Law – 2023 Edition, Partner David Kroeger and former department counsel Catherine Doyle discuss the role of exclusions found in some insurance policies. The chapter explores different types of exclusions, how they are interpreted, and the factors that are considered by the court when determining whether the exclusions will defeat coverage.

In their article, Partner David Kroeger and Associate Huiyi Chen explore the market for cyber insurance coverage. They focus on the trend in which insurers are limiting coverage for “state sponsored” or “state backed” cyber incidents—in other words, incidents perpetrated by a government or nation state against another state. For companies that rely on cyber insurance coverage, such reductions in coverage could be significant, the authors observe.
