マイクロプラスチックが大規模訴訟につながる恐れ

マイクロプラスチックとは、プラスチック製品が長年の使用により劣化する過程で放出される小さなプラスチック粒子のことであり、あらゆる環境に存在する1 。マイクロプラスチックが人体にどのような影響を与えるかを示す決定的な科学的根拠はまだないが、マイクロプラスチックによる健康への影響の可能性については注目が高まっており2 、クラスアクションの原告側弁護士も着目している。

近年、大手メーカーに対して、その製品に有害なマイクロプラスチックが含まれているとして訴訟が提起された。これらの訴訟で、原告側は、概して、製品にマイクロプラスチックが含まれていることが開示されていないことから、その製品のラベル表示やブランド名が誤解を招くものである、と主張している。例えば、Daly v. Danone Waters of America, LLC訴訟において、原告側は、湧き水(Spring water)のボトルにはマイクロプラスチックが含まれているにもかかわらず、そのラベル表示に「Natural」と記載されていたことから、ラベル表示は誤解を招くものである、と主張した。裁判所は、連邦法による規制において、「Spring water」は、例えば「natural spring」(天然の湧き水)を水源とする水と定義されていると述べ、被告のラベル表示はこの定義に準拠しているため、(連邦法による規制以上の規制を要求する)原告の請求は連邦法と抵触する(原告の請求は連邦法によりpreempt(専占)される)と判断し、訴えを却下した3

また、別のクラスアクションにおいて、原告側は、哺乳瓶のラベル表示が誤解を招くものであり、哺乳瓶を加熱するとマイクロプラスチックが溶出することを開示していないとして、哺乳瓶メーカーを相手取って訴訟を提起した。最近の判決であるMiller v. Philips North America LLC において、原告は、「BPA Free」という表示にはマイクロプラスチックについての言及がないことから、製品にマイクロプラスチックが含まれていないと消費者に伝わっている、と主張した。カリフォルニア州北部連邦地方裁判所はこの原告の主張を却下したが、哺乳瓶を加熱するとマイクロプラスチックが溶出することを被告が開示しなかった、という原告の主張については、審理を継続する判断を下した4

ラベル表示やマイクロプラスチックに関連する訴訟に巻き込まれた企業には、様々な防御策が考えられる。例えば、Daly事件のように、特に争点となっている製品が連邦の規定によって定義されている場合、規制が原告の主張よりも優先すると主張できる可能性がある。また、Miller事件のように、企業は製品のラベル表示は明確であり、マイクロプラスチックに関する情報はラベルに含まれていないと主張できる可能性がある。どのような防御策が利用できるかは、最終的には個々の事例の具体的な事実によって決まる。

原告側は、新たな製品を対象として、マイクロプラスチックの有無に関する主張をする可能性が高い。プラスチック製品を製造する企業(特に食品や飲料に関連して使用される製品を製造する企業)は、ラベルを見直し、マイクロプラスチックの有無について積極的な表現がないかを検討することが有益と考えられる。また、こうした企業は、潜在的なリスクを最小限に抑えるために、マイクロプラスチックに関する政府規制(アメリカ食品医薬品局(FDA)など)の動向にも注意を払う必要がある。
