In a significant victory for pharmaceutical competition and access to generic drugs, Jenner & Block secured a key litigation win on behalf of client MSN Pharmaceuticals. A federal judge denied a pharmaceutical company’s request for injunctive relief, removing an obstacle to MSN’s planned launch of a generic version of Entresto, a widely used heart failure medication.

On February 26, 2025, in a unanimous opinion, the US Supreme Court vacated a $43 million trademark infringement award and ruled that trademark plaintiffs cannot recover profits from defendants’ affiliates when those affiliates are not themselves named as defendants in the lawsuit.[1]The Supreme Court’s decision vacated plaintiff Dewberry Engineers’ award because it disgorged profits from defendant Dewberry Group’s affiliates without those affiliates being parties to the suit.

This week, the US Court of Appeals for the Second Circuit upheld a Jenner & Block’s team 2022 jury trial win that protected beverage maker Diageo’s trademarked design of its distinctive Bulleit bourbon and rye whiskey bottles.

A team of Jenner & Block lawyers secured asylum for a pro bono client and his family who were forced to flee their home country of Afghanistan following the Taliban’s takeover of Kabul in August 2021. Our client and his family were facing persecution from the Taliban due to his former work as a contractor for foreign entities including the U.S. Army and work as a prosecutor for the former Afghan government. 

After a month-long trial in the Western District of Texas, a federal jury determined that Grande Communications Networks LLC must pay more than $46.7 million to a group of record labels, after its users pirated over 1,400 copyrighted songs.
