Daniel Schwei helps clients navigate high-stakes disputes, particularly in matters involving state or federal governments, administrative and constitutional law, and complex regulatory regimes. He draws on more than a decade of experience at the US Department of Justice (DOJ), where he defended federal agencies, programs, and officials as a senior litigator in the Civil Division’s Federal Programs Branch.
While at DOJ, Daniel handled many of the federal government’s most significant and high-profile civil cases. Virtually all of his cases involved novel questions of administrative or constitutional law in subject areas including healthcare and pharmaceuticals, federal preemption, government appropriations law, and reproductive rights. Among other notable cases, he was part of the team that defended FDA’s approval and regulation of the drug mifepristone in Alliance for Hippocratic Medicine v. FDA (N.D. Tex.), and he personally argued in defense of FDA’s actions at the preliminary-injunction hearing.
Since joining Jenner, Daniel has continued to litigate complex cases for clients across industries, from consumer-facing businesses such as hospitality and technology companies to higher education institutions. Daniel personally briefs and argues cases at all stages of civil litigation in state and federal courts. He also advises clients outside of litigation, drawing on his government experience to evaluate risk, identify options, and develop solutions that help clients achieve their goals.
