David and the Jenner team achieved a significant victory when the Ninth Circuit Court of Appeals agreed with the Review-Journal's interpretation of the Newspaper Preservation Act and reversed the trial court's denial of a motion to vacate a stipulated preliminary injunction. The case centers on a 2005 Joint Operating Agreement that was never approved by the US Attorney General as required by law. The Review-Journal successfully argued that this failure rendered the agreement unlawful and unenforceable, which would invalidate the antitrust claims.

David, who is co-chair of Jenner’s Antitrust and Competition Law Practice and Content, Media and Entertainment Practice, shared insights about his approach to complex antitrust matters. "When it comes to antitrust law, there are lots of angles for attacking a problem and a sea of nuanced (and sometimes conflicting) case law," David said. "Keep it simple.
