Jenner & Block Expands Antitrust and Competition Law Practice with Addition of Former FTC Lawyers Christopher Renner and Douglas Litvack

Firm Strengthens Antitrust Litigation and Investigations Capabilities with the Arrival of Two Co-Chairs

WASHINGTON, DC – AUGUST 30, 2021 – Jenner & Block is pleased to announce that experienced antitrust litigators Christopher G. Renner and Douglas E. Litvack will join as partners, building on the firm’s antitrust strength and success. Mr. Renner, who will be located in Chicago, and Mr. Litvack, located in Washington D.C., will serve as co-chairs of the firm’s Antitrust and Competition Law Practice alongside Partner Lee Van Voorhis.

The pair have extensive experience representing both plaintiffs and defendants in complex antitrust litigation, government investigations, and pre-clearance matters. Prior to entering private practice, both Mr. Renner and Mr. Litvack served as attorneys at the Federal Trade Commission.

Mr. Renner served as an attorney advisor to the FTC chairman and acting deputy assistant director of the Anticompetitive Practice Division of the Bureau of Competition. He received the FTC’s Paul Rand Dixon Award for his contribution to the FTC’s antitrust enforcement efforts.

Mr. Litvack served as an attorney in the FTC’s Bureau of Competition, Mergers IV Division and Litigation Group where he played a significant role in several antitrust investigations and litigations. He received several awards for his contributions to the FTC’s merger enforcement program, including the Stephen Nye Award, the Commission’s highest honor awarded to young lawyers.

“Chris’s and Doug’s FTC experience as well as their litigation and transactional capabilities enhance our ability to support clients on all aspects of antitrust,” said Katya Jestinand Randy Mehrberg, Jenner & Block’s co-managing partners. “We are excited to welcome them to the firm.”

Mr. Renner’s practice focuses on representing technology, healthcare IT, and medical supply companies, often as plaintiffs in cases involving allegations of exclusionary conduct. He also has significant experience representing clients before both state and federal as well as international enforcement agencies.

Mr. Litvack’s practice focuses on defending companies before federal antitrust enforcement agencies and state attorneys general, in addition to antitrust litigation and counseling. He represents clients across a variety of industries, including healthcare and life sciences, consumer products, and aerospace and defense.

“Chris and Doug have a great reputation in the antitrust bar,” said Mr. Van Voorhis. “Their diverse, yet complementary, practices add to our existing bench strength and boost our sophisticated antitrust ligation, transactional, and investigations practice.”

In a recent Sixth Circuit victory, Mr. Litvack and Mr. Renner defended ProMedica Health System from a competitor’s refusal-to-deal allegations. The panel unanimously overturned an injunction that barred the vertically integrated nonprofit healthcare provider from terminating contracts with the competitor. The ruling expressly recognized that ProMedica "had a legitimate business explanation" for terminating the contract and that their refusal to deal will promote competition and benefit the Toledo community.  The panel opinion is the leading Sixth Circuit precedent on a firm’s duty to deal with competitors under the antitrust laws.

They have also helped clients navigate complex antitrust issues and obtain regulatory clearance. These representations have included securing antitrust clearance from the US Department of Justice for The Carlyle Group in its $2.1 billion sale of Landmark Aviation to BBA Aviation plc, and obtaining clearance from the FTC for Cintas’ $2.2 billion acquisition of G&K Services.

Mr. Renner and Mr. Litvack join the firm from Davis Wright Tremaine.

Mr. Renner earned his JD from New York University School of Law and his BA from St. John’s College.

Mr. Litvack earned his JD from Georgetown University Law Center, cum laude, and his BA from Colgate University.
