Jenner & Block Files Amicus Brief Highlighting Petitioner’s Flawed Invocation of Moore v. Harper

On behalf of the Brennan Center, Campaign Legal Center, the Protect Democracy Project, and the League of Women Voters, a Jenner & Block team filed an amicus brief in the case of Donald J. Trump v. Norma Anderson where Donald Trump asked the US Supreme Court to reverse a Colorado ruling barring him from the state’s primary ballot. The brief explains the “legal errors in Petitioner’s reading of Moore v. Harper and the threats that erroneous reading presents to free, fair, accessible, and workable elections.”
The brief, which was on behalf of neither party, argues that Petitioner’s invocation of Moore v. Harper as an invitation to second-guess the Colorado Supreme Court’s interpretation of Colorado law is flawed, and accepting his framing of the case would wreak the havoc the Court avoided last term when it rejected the so-called independent state legislature theory.
“Moore reaffirmed the longstanding, basic principle that state election laws are subject to judicial review by state courts,” the brief said.
The team is being led by Partner Michelle Kallen with support from Associate Emmanuel Powell III and Law Clerk Donovan Hicks.
Partners Jessie Amunson and Sam Hirsch successfully represented the North Carolina League of Conservation Voters in the US Supreme Court in Moore v. Harper.
