Jenner & Block Advocates for Navajo Nation Water Rights in Amicus Brief before US Supreme Court

On February 8, Jenner & Block filed an amicus brief in the US Supreme Court on behalf of leading historians in support of the Navajo Nation in Arizona v. Navajo Nation. The case concerns the Nation’s efforts to enforce the United States’ treaty-based duty to assess and meet the Nation’s water needs.

As argued by the brief, “the historical record reveals that Congress and the Executive have bound themselves since the Founding to protect and care for Native nations—including  by ensuring they have adequate water for their homelands—and that Congress has tasked the Judiciary with holding the Executive accountable through suits like this one.”

The team is led by Senior Associate Lenny Powell in collaboration with NYU-Yale American Indian Sovereignty Project. Jenner & Block lawyers on the team include Partner Sam Hirsch and Associates Emiliano Aguirre and Abraham Kanter. Law Clerk Axel Hufford also assisted.
