Client Marriott Secures Interlocutory Appeal of Class Certification in Multidistrict Litigation Regarding Data Security Incident

A team of Jenner & Block lawyers helped secure an order from the US Court of Appeals for the Fourth Circuit granting a petition for a quick appeal of the class certification order in the multi-district consumer litigation concerning Marriott’s 2018 data security incident.
In May, the federal court in Maryland granted class certification to seven bellwether classes and subclasses of approximately 20 million individuals for claims that their personal information was compromised by a data security incident involving Starwood’s guest reservation database.
In the petition, the team argued that determining the standing and class membership of each individual would require millions of mini-trials to determine who suffered an economic loss from the incident. Additionally, the district court erred in certifying a class action that everyone in the class had waived the right to pursue.
