Leonard Powell Discusses the Most Impactful Native American Law Cases of 2022 in Law360

Senior Associate Leonard Powell spoke about the most impactful Native American Law appellate and US Supreme Court cases of the year so far in three recent Law360 articles. The cases include Denezpi v. US, in which Mr. Powell submitted an amicus brief on behalf of federal Indian law scholars and historians, and Brice et al. v. Stinson et al.

When discussing Denezpi, Mr. Powell told Law360 that the decision was "a significant victory for tribes who rely on CFR courts to enforce tribal law" and marked "a strong reaffirmation of the principle that tribes are separate sovereigns, and thus prosecutions under tribal law fall within the dual-sovereignty exception to the double jeopardy clause." He discussed the potential implications of the Ninth Circuit’s en banc grant in Brice et al. v. Stinson et al. in another article.

He also spoke with Law360 about the impact of Justice Neil M. Gorsuch in a third article

Mr. Powell represents clients before appellate and trial courts throughout the US in cases raising high-stakes issues of constitutional and statutory interpretation, administrative law, criminal procedure, and federal Indian law, among others. He regularly briefs matters before the United States Supreme Court, where he has won three cases on the merits and successfully opposed dozens of petitions for certiorari. Mr. Powell also advises clients facing critical strategic decisions at the trial-court level and litigates case-dispositive motions.
