This program features an introduction by Jenner & Block Co-Managing Partner Katya Jestin and explores how the daily challenges and obstacles of pandemic living have tested lawyers’ resiliency in their personal and professional lives. Presenters Melissa Root, David Singer, Dawn Smalls, and Kirsten Spira will also demonstrate how developing a resilient mindset can help manage those challenges and model the Rules of Professional Conduct.
 
 
 

Addressing Workplace Misconduct Claims during Rapid Cultural Change

In this program, Chris Braamskamp, Anne Cortina Perry, and Alison Stein examine approaches to addressing workplace culture concerns in the face of social activism and increased emphasis on diversity and inclusion. With an introduction by CLE Relay Chair Ross Bricker, the instructors cover potential considerations for workplace investigations and highlight ethical obligations including those under Rule 8.4(g). Covering both a US and European perspective, the discussion will address practical and strategic considerations specific to conducting investigations, preparing for potential litigation, and managing internal constituencies in sensitive and complex matters.
 
 
 

Navigating Ethical Issues in Complex Investigations and Litigations

Nicole Allen, Kevin Murphy, Tom O’Neill, Shoba Pillay, Megan Poetzel, and Charles Riely will give an update on the law and pertinent ethical rules in this program. After an introduction by Jenner & Block Partner Ross Bricker, presenters will discuss in-house and outside counsel perspectives and regulator perspectives on issues such as asserting privilege in internal investigations, dealing with joint defense group conflicts, challenges in multiple party representation, how and when to decide whether to report misconduct, responding to requests for internal investigation materials in litigation, and assessing the impact of electronic discovery protocols upon a party’s continuing obligation to supplement discovery responses.

Almost six months into the Biden administration, instructors Rachel Alpert, Aaron Cooper, Madeleine Findley, Suedeen Kelly, and Gay Sigel will examine opportunities and risks posed for businesses. Our presenters have held roles at the US State Department, Federal Energy Regulatory Commission, Federal Communications Commission, US Attorney’s Office, and Senate Select Committee on Intelligence. They will provide unique insight into energy, communications, sanctions, climate change, environmental policy, and cybersecurity. The program will feature an introduction by Anna Meresidis.

 
 
 

LGBTQ Cultural Competency: What Every Lawyer Needs to Know

The legal profession continues to maintain significant gaps in LGBTQ inclusion, according to the latest NALP Report on Diversity. The June 2020 Supreme Court Bostock decision has made addressing this problem even more relevant. Featuring an introduction by Jenner & Block Co-Managing Partner Randy Mehrberg, this session will give attendees the tools necessary to create meaningful change in the legal profession to help close those gaps. Presented by an openly transgender lawyer with a background in transgender rights litigation, the program will provide an intersectional approach to increasing fluency in matters related to sexual orientation, gender identity, and gender expression, and inspire allies into practical action. The presenters include M. Dru Levasseur (The National LGBTQ Bar Association), Ali Arain, Matt Cipolla, Lindsay Harrison, and Andrew Plague.

 
 

Annual Supreme Court Term in Review

The final leg of the CLE Relay is reserved for our Annual Supreme Court Term in Review. This dynamic, timely CLE program will feature Ian Heath Gershengorn, former Acting Solicitor General of the United States and current chair of our Appellate and Supreme Court Practice. He will be joined by other members of the nationally recognized group, including Partners Jessie Amunson, Ishan Bhabha, Matt Hellman, Tassity Johnson, and Adam Unikowsky.
 
Panelists will engage in a lively and informative discussion on the recent past, current, and future US Supreme Court terms. They will focus on the vast changes in the Administration and the Court’s structure, covering the post-Justice Kennedy landscape and a tribute to Justice Ginsburg, as well as an overview and analysis of Justice Barrett’s first term. The panel will also discuss high-profile cases surrounding religion, the election and associated voting issues, the revitalization of the Affordable Care Act, collegiate athletes, and big tech. They will also share their predictions on the next term with respect to abortion, Second Amendment, and Affirmative Action cases.
