In their article for Law360, Partners Michelle Kallen, Madeleine Findley, and David Layden and Associate Daniel Echeverri discuss the impact of data privacy laws that have recently taken effect in five states and how companies can understand what the laws regulate and enforce.
In the current edition of Pratt's Privacy & Cybersecurity Law Report, Partners David Layden, Annie Kastanek, and Caroline Meneau discuss the decision by the Illinois Supreme Court in Cothron v. White Castle System, Inc. The court ruled that a separate claim accrues under the Illinois Biometric Information Privacy Act each time a private entity scans or disseminates an individual’s biometric identifier or information in violation of Sections 15(b) or (d) of the law.
On May 18, 2023, the Federal Trade Commission (FTC) adopted a Policy Statement on biometric information that details its “significant concerns” arising from the increasing use of biometric information and technologies that use (and “purport to use”) biometric information. The statement also affirms the FTC’s commitment “to combatting unfair and deceptive acts” related to the collection and use of biometric information and marketing and use of biometric technologies.
