Michelle M. McAtee is a partner in Jenner & Block’s Chicago office. She is a member of the Firm’s Real Estate and Real Estate Securities Practices and its Tenant-in-Common Workout Task Force.
Ms. McAtee has represented lenders, borrowers, landlords, tenants, developers, sellers and purchasers throughout the country in connection with all aspects of real estate transactions. She has significant experience in representing lenders, borrowers and real estate private equity sources in connection with complex commercial loans and capital market transactions, as well as experience in restructuring and workouts, including the negotiation of forbearance agreements and foreclosure work. Ms. McAtee regularly represents a pension fund in connection with its acquisition and financing of office and multi-family housing projects in the greater Chicagoland area. She recently represented a seller in a complex transfer of membership interests in a Manhattan hotel in Times Square. Ms. McAtee also regularly represents lenders, including a lender in a project that included a $138 million construction loan financing and syndication for the development of an open-air retail shopping center in Arkansas. She has extensive leasing experience, representing both landlords and tenants in office, retail, warehouse and industrial leases.
In addition to her real estate practice, Ms. McAtee practices in the area of Real Estate Securities. She represents clients in the acquisition and financing of retail, office, warehouse and multi-family housing projects across the country, and prepares their Regulation D private placements of fractionalized interests in such real estate (structured either as Tenants-in-Common or Delaware Statutory Trust interests).
In 2008, Ms. McAtee was selected to become a member of CREW Chicago (Commercial Real Estate Women), a professional business organization dedicated to the advancement of women in commercial real estate. Ms. McAtee is a member of the Legal Advisory Committee of The Catholic Charities of the Archdiocese of Chicago, and has a number of additional pro bono clients.
Ms. McAtee co-authored the American Law Institute-American Bar Association articles titled "What You Should Know About Wind Farms" and "Surrender Dorothy: Restoration Obligations in Office Leases," published in The Practical Real Estate Lawyer, as well as the Firm’s Real Estate Practice Client Advisory titled, “River East - A Tale of Caution for Lenders and Borrowers.”
Ms. McAtee earned her law degree from the University of Iowa College of Law in 1998, and her B.S. from Marquette University in 1995, cum laude. Prior to joining Jenner & Block, Ms. McAtee was an associate at Wildman, Harrold, Allen & Dixon, LLP in Chicago, Illinois, and at Goodwin Procter LLP in Boston, Massachusetts. She is a member of the real property, probate and trust law section of the American Bar Association, and is active in several real estate organizations, including the Illinois Chapter of Real Estate Investment Association. Ms. McAtee is also a member of the Chicago Bar Association and the Illinois State Bar Associations. She is licensed to practice both in Illinois and in Massachusetts.
