Navigant Consulting, Inc. Legal Roundtable: Dilemmas Caused by Landmark Supreme Court Decision in Aviall v. Cooper Robert L. Graham, James A. Vroman, and Bill S. Forcade Chicago, IL
Jenner & Block Partners Robert L. Graham, James A. Vroman and Bill S. Forcade will lead a Navigant Consulting Legal Roundtable entitled, “Dilemmas Caused by Landmark Supreme Court Decision in Aviall v. Cooper Industries, Inc.” on February 1 at the Union League Club in Chicago. Messrs. Graham, Vroman and Forcade will discuss a December 2004 U.S. Supreme Court opinion that fundamentally changed cost recovery in environmental matters and cast a cloud over nearly all pending CERLCA litigation. In Aviall, the attorneys note, the Court dramatically limited the ability of companies to recover costs associated with environmental cleanup from other third parties who may have contributed to the contamination of property.
Among the topics the roundtable will address include: strategic business issues, coordination with regulatory agencies, financial reporting implications, possible legislative solutions, new approaches to cleanup and the impact on pending recovery efforts.
