Jared O. Freedman is a partner in Jenner & Block's Washington, DC office.  He is a member of the Firm's Litigation Department and the Media and First Amendment, and Creative Content Practices.

Mr. Freedman has litigated a wide array of First Amendment, new media, and traditional media cases at both the trial and appellate level, with a focus on online copyright issues.  He has recently represented the record industry and recording artists in a series of proceedings before the United States Copyright Royalty Board to set the royalty rates for the performance of sound recordings by webcasters and satellite radio, and the rates for the reproduction and distribution of musical compositions.  He has also represented the recording industry in cases arising under the Digital Millennium Copyright Act (DMCA), as well as in numerous copyright infringement and digital piracy cases.

Mr. Freedman's other work has included successfully defending media clients in federal district court and the Seventh Circuit on First Amendment grounds in a defamation case involving reporting on the war on terrorism, winning summary judgment for a telecommunications client in complex civil litigation in federal court, obtaining a favorable judgment for a telecommunications client in a multi-million dollar arbitration, successfully defending a professional medical association in federal district court and the Fourth Circuit in a defamation lawsuit arising out of an article published in the association's journal, and conducting an internal investigation of a government contractor.  Mr. Freedman's appellate practice has included drafting several briefs in copyright cases on behalf of the recording industry in the United States Supreme Court and federal courts of appeals.  He has also successfully represented a client in a Supreme Court case involving interpretation of the Age Discrimination in Employment Act.

Mr. Freedman has extensive trial experience.  He has managed all aspects of complex civil litigation, presented opening argument, conducted direct and cross examinations of witnesses, argued dispositive and evidentiary motions, and worked closely with expert witnesses.

Mr. Freedman maintains an active pro bono practice, which has included representing a foreign national seeking asylum as a result of persecution in his home country, representing a death-row inmate in habeas corpus proceedings in the Georgia state courts, drafting amicus briefs to the United States Supreme Court on a host of issues, including ineffective assistance of counsel claims in death penalty cases, the constitutionality of federal legislation regulating speech on the Internet, and application of the Individuals with Disabilities Education Act.

Mr. Freedman graduated magna cum laude from Harvard College in 1991, and received his J.D. from Yale Law School in 1997.  Following law school, Mr. Freedman served as a law clerk in 1997-98 for Justice Dana Fabe of the Alaska Supreme Court, and for Judge Michael A. Ponsor of the United States District Court for the District of Massachusetts in 1998-99.  Mr. Freedman is a member of the bars of New York and the District of Columbia.
