David A. Churchill is the Co-Chair of the Government Contracts Practice and a partner in the Firm's Litigation Department.  He is Past President of the U.S. Court of Federal Claims Bar Association.  In 1998-99, he was chair of the Public Contract Law Section of the American Bar Association.  In November 2004, he was named a "leading lawyer" in Government Contracts by the editors of Legal Times.  Since 2005, Chambers & Partners USA has named Mr. Churchill one of the country’s leading lawyers in Government Contracts Law.  Mr. Churchill is AV Peer Review Rated, Martindale-Hubbell’s highest peer recognition for ethical standards and legal ability.  In 2009, Mr. Churchill was recognized by Ethisphere Magazine in their 2009 list of “Attorneys Who Matter” in the Government Contracting category.  Mr. Churchill was also named one of "Washington's Top Lawyers" by Washingtonian magazine and was recognized in the 2010 edition of Washington DC Super Lawyers for Government Contracts law.

Mr. Churchill practices before the major forums for resolution of federal contract award and performance disputes, including the Court of Federal Claims, the agency boards of contract appeals and the Government Accountability Office.  He also counsels in matters involving the award and performance of international public contracts under the U.S. Foreign Military Sales and Foreign Military Finance programs.  He has experience in conducting domestic and international arbitration proceedings and various types of alternative dispute resolution techniques.

Mr. Churchill received his B.A., magna cum laude, in 1974 from the University of Colorado and also attended the University of Vienna in Austria.  He received his J.D., cum laude, in 1979 from Cornell University where he was editor-in-chief of the Cornell International Law Journal.  Mr. Churchill was a law clerk to the Honorable Louis Spector, Trial Judge, United States Court of Claims.  Mr. Churchill is admitted to practice in the District of Columbia.

Representative matters across the spectrum of government contract law include:

  • Protest of Cherry Road Technologies and Electronic Data Systems Corporation (Government Accountability Office):  Mr. Churchill was lead counsel to Lockheed Martin Corporation in a major bid protest proceeding involving the award of a large U.S. Army contract for an Army online knowledge program.

  • Protest of United Defense, LP (General Accounting Office):  Mr. Churchill was lead counsel to General Dynamics Corporation in a large bid protest proceeding involving the award of a U.S. Army contract for development and production of the Stryker armored vehicle.

  • McDonnell Douglas et al. vs. United States  (Court of Federal Claims):  Mr. Churchill and the Firm represent General Dynamics Corporation in litigation involving a classified contract for development and early production of an advanced attack aircraft for the U.S. Navy.

  • Thomson CSF vs. Lockheed Martin Corporation (ICC):  Mr. Churchill was lead counsel in an ICC international arbitration brought by a French company against Lockheed Martin involving the development and testing of a short range antiaircraft missile.

  • Norden Systems, Inc. vs. General Dynamics Corporation (Conn. state court):  Mr. Churchill represented General Dynamics Corporation in a suit brought by a subcontractor involving termination of a large, classified avionics subcontract. 

Mr. Churchill has an active counseling practice in proposal and award-related matters involving government contracts, including domestic preference requirements, such as Buy American and Trade Agreements Acts, gratuities and procurement integrity issues, Truth in Negotiations Act requirements, and suspension and debarment of prime and subcontractors.  He counsels regularly on issues arising during performance of government contracts and subcontracts, such as changes, delays and claims preparation.
